BORROWERS; LOAN PROJECTS
6. Data collected regarding borrowers
When you register as a borrower on Crowd4cash, we collect the following personal data and store it in your user profile:
Private individuals
Gender (salutation), title, first name, last name, address, date of birth, employer details, number of children, telephone number(s), your email address, the IP address of the device you use and a password of your choice (in encrypted form) for registration on Crowd4cash.
Company
Regarding the borrower: company, legal form, company website (optional), address, email address, telephone number(s), number of employees, date of establishment, branch of industry, and bank details (account holder and IBAN);
Regarding the borrower's authorized signatory(s): first name, last name, date of birth, place/country of birth, nationality, function in the company, address, email address and telephone number(s),
In connection with the borrower's user account: the IP address from which registration and further access takes place, the password (in encrypted form) for authenticating the borrower on Crowd4cash.
We process and use your borrower data to the extent that this is necessary for the proper fulfillment of our contract for the use of Crowd4cash.
7. Loan project data
If you, as a borrower on Crowd4cash, want to activate a loan project for business purposes or obtain non-binding information about possible loan amounts and financing conditions, we generally collect the following data:
- Title of the loan project, desired amount, desired loan term, purpose of the loan, extract from the debt collection register
- Information on current loans, liabilities and long-term payment obligations of the borrower (if any)
Additionally for private individuals
- Income, financial obligations, documents such as rental agreement/mortgage agreement, health insurance policy
Additionally for companies
- Annual financial statements for the last 2 reporting periods, auditor's report (if available), bank statements if applicable.
8. Obtaining information about the borrower from credit agencies
Before activating the loan project and, if applicable, before providing non-binding information on possible loan amounts and financing conditions, we obtain information about the borrower from one or more of the following credit agencies, in particular about creditworthiness and the existence of negative characteristics in companies, in addition to the shareholding structure and business figures. In doing so, payment experience, in particular about undisputed claims and claims that have not been paid after they have become due, as well as, if applicable, debt collection information and address data can be transmitted:

The creditworthiness is determined and presented by the requested credit agencies using address data. Negative characteristics are characteristics that indicate, for example, an ongoing debt collection, bankruptcy or probate procedure or an above-average risk of default.
As a borrower, you agree that Crowd Solutions AG may obtain credit information about you from CRIF AG, Hagenholzstrasse 81, 8050 Zurich, and/or Intrium AG, Eschenstrasse 12, 8603 Schwerzenbach, the Central Office for Credit Information (ZEK), P.O. Box 1108, 8048 Zurich and/or the Information Office for Consumer Credit (IKO), P.O. Box, 8048 Zurich and may transmit the borrower's data to these credit agencies. In addition, you agree that Crowd Solutions AG may also obtain additional debt collection information about the borrower.
9. Processing of data
Personal data is all information relating to an identified or identifiable person. A data subject is a person about whom personal data is processed. Processing includes any handling of personal data, regardless of the means and procedures used, in particular the storage, disclosure, acquisition, deletion, storage, modification, destruction and use of personal data.
We process personal data in accordance with Swiss data protection law. Furthermore, we process personal data - to the extent and insofar as the EU GDPR is applicable - in accordance with the following legal bases in connection with Art. 6 Para. 1 GDPR:
lit. a) Processing of personal data with the consent of the data subject.
lit. b) Processing of personal data to fulfill a contract with the data subject and to carry out corresponding pre-contractual measures.
lit. c) Processing of personal data to fulfill a legal obligation to which we are subject under applicable EU law or under applicable law of a country in which the GDPR is fully or partially applicable.

Crowd Solutions AG will include the loan project data together with the information from the credit agencies in a preliminary check to determine whether the borrower can be activated on the platform. As part of the preliminary check, we will process and use the data collected. This check will allow us to calculate the borrower's probability of default and a risk-weighted interest rate that will be used as a basis if the loan project is activated.
After financing the loan project, we process and use your data to generate the necessary contract documents for concluding a loan and, if applicable, the guarantee contracts and make them available to you for download on Crowd4cash. If necessary, we will contact you using your data to request any additional information required for the steps following the financing.
10. Disclosure of data to credit agencies
For loans that are subject to the KKG (Federal Law on Consumer Credit), we are legally obliged to provide data to the Information Office for Consumer Credit (IKO) about the application, any rejection, the acceptance (in each case the borrower and the loan amount as well as the term and start of the installments) and the agreed processing. In addition, data about obligations and any changes in creditworthiness must be provided to the Central Office for Credit Information (ZEK).
We also transmit to the IKO/ZEK data on outstanding claims arising from a loan agreement against a borrower if the borrower has not rendered the service owed despite it being due, and
- the borrower has been reminded in writing at least twice after the claim has become due, the debt collection proceedings have been initiated and the borrower has not contested the claim or the outstanding claims amount to at least 10 percent of the net amount of the loan or
- the contractual relationship underlying the claim was terminated without notice due to payment arrears
11. Disclosure of data to insurance companies within the framework of credit insurance (only for private individuals)
You as the borrower agree that Crowd Solutions AG may disclose and/or make available to third parties who are called in to carry out activities within the framework of the mandatory and optional insurance all information and personal data that are necessary for the processing of the insurance. In particular, you agree that third parties called in may be informed that you are a customer of Crowd Solutions AG. In this context, you release Crowd Solutions AG from any responsibility in connection with the transfer of data. At the same time, you release your doctors, official bodies and other insurers from the applicable duty of confidentiality and secrecy towards Crowd Solutions AG, the insurer and the third party commissioned by the insurer to process the claims. The acquisition and processing of the personal data collected from you as an insured borrower is carried out in compliance with the Federal Data Protection Act (DSG). 12. Processing of data in the context of granting the guarantee
If it becomes apparent during the loan application process or during the credit check that we can only launch the loan project if one or more guarantees are provided, we will transmit your data, provided that you as the borrower have declared your general willingness to provide a guarantee for a loan during the registration process, and obtain information from one or more credit agencies about the creditworthiness of the guarantor and the existence of negative characteristics. We can also request that the guarantor provides us with current extracts from the debt collection register.
If you, as another third party, have also agreed in principle to conclude a guarantee agreement so that we can provide a loan for a requested loan project, we will collect and store the following data:
- If it is a legal entity or partnership: company name, legal form, address, if applicable, company identification number (UID) as well as gender (salutation), title, first name, last name, date of birth and address of the authorized representative
- If it is a natural person: name, first name, address, date of birth and nationality
We process and use this data for the purposes of the guarantee contract and in particular to contact you.
As a borrower or guarantor, you agree that we may obtain credit information about you from

13. Disclosure of data on Crowd4cash
If you activate the loan project, the following data will be displayed on Crowd4cash for visitors to the platform to view:
Private individuals
- Age, occupation, number of children, living situation, nationality, income, free funds, debt collection, rating, guarantees and whether insurance has been taken out
- Loan amount, loan term, monthly loan installment, interest rate, purpose of the loan, and remaining financing period
Company
- Legal form, industry, year of establishment, number of employees, any guarantees, credit score, rating, location of company headquarters
- Title of the loan project, loan amount, loan term, monthly loan installment, interest rate, purpose of the loan, details of the financing ratio, result of the completed questionnaire and remaining financing period
- Description of the loan project, financial indicators (relevant business indicators of the company and financial ratios)
For companies, the company and other information about the borrower are also displayed to logged-in investors on Crowd4cash.

14. Data collected concerning investors
The following data is collected from the investor:
Gender (salutation), title, first name, last name, address, telephone number(s), your email address, your bank details (account holder and IBAN), the IP address of the device you use and a password of your choice (in encrypted form) for registration on Crowd4cash

15th Treaty
The purchase of (or part of) a future credit claim from us against the borrower by the investor and the assignment based on the claim purchase agreement generally takes place without disclosing the investor's name or other personal data.
16. Disclosure of data to insurance companies when making an offer and taking out insurance for non-credit insurance companies
If you, as a borrower, agree to receive insurance offers, you agree that Crowd Solutions AG may disclose and/or make available to third parties who are called in to carry out activities related to premium calculation or other related activities, all information and personal data that are necessary for the offer, conclusion and processing of the insurance. In particular, you agree that third parties called in may be informed that you are a customer of Crowd Solutions AG. In this context, you release Crowd Solutions AG from any responsibility in connection with the transfer of data. The acquisition and processing of the personal data collected from you as an insured borrower is carried out in compliance with the Federal Data Protection Act (DSG). The data is collected, processed, stored and deleted physically and/or electronically in accordance with the statutory provisions. It is protected against unauthorized access and modification.
17. Announcement to cooperation partners
We cooperate with various banks and credit brokers at home and abroad and are planning such cooperations for the future. We can pass on data to cooperation partners as part of the financing.
In the event that the financing of a loan project does not materialize or the project cannot be financed by Crowd4Cash (negative credit check or similar), with the consent of the borrower, we can forward the documents for the loan project to our cooperation partners, who will then check whether they can finance the loan project or arrange financing for it. The borrower is always informed of the transfer and tacit consent is assumed accordingly, unless approval is refused immediately after the request or if further documents are submitted. Our cooperation partners will save the data received and process and use it as part of their check to see whether they can finance the loan project and arrange financing for it. The processing of the data by the cooperation partners is carried out in accordance with the respective data protection guidelines of the cooperation partners.
As a borrower, you agree that we may, after your consent (including tacit consent), send data about you to the following companies:
